Terms of Service

To use the Service you must:

• Be at least 16 years of age (or 13 if permitted by applicable law in your jurisdiction, subject to parental consent where required).
• Provide accurate, current, and complete registration information.
• Maintain the security of your credentials and notify us immediately of any unauthorised access.
• Not maintain more than one free account per person or legal entity.
• Have the legal capacity to enter into a binding contract in your jurisdiction.

You are fully responsible for all activity that occurs under your account. We reserve the right to refuse registration or cancel accounts at our sole discretion.

LinkSnap AI is an AI-powered marketing and smart link management platform that includes, without limitation:

• Smart Links & URL Shortening — create, brand, and manage short links with deep-link routing.
• Analytics — real-time click tracking, geographic data, device breakdown, and conversion reporting.
• AI Marketing — AI-generated ad copy, captions, campaign content, and marketing strategies.
• AI Image Generation — create images using third-party AI models (standard, HD, and 4K quality tiers).
• AI Video Generation — create videos via Veo3, Seedance, and Kling AI models.
• AI Music & Audio Generation — create music tracks and text-to-speech audio.
• AI Avatar & Lipsync — create talking avatar videos via HeyGen.
• Credits System — a pay-as-you-go layer for AI feature consumption.
• Referral Program — earn commissions by referring new paying customers.
• QR Code Generation — QR codes for any smart link.
• Password-Protected Links — access-controlled destination URLs.

We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time. Where practicable, we will provide at least 14 days' notice of material changes.

You agree that you will not use the Service, or permit others to use it, to:

• Distribute malware, ransomware, spyware, phishing pages, or any other malicious code or content.
• Engage in or facilitate illegal activity under any applicable national, state, or local law.
• Infringe the intellectual property rights, privacy rights, or any other rights of third parties.
• Send unsolicited bulk messages (spam) or violate the CAN-SPAM Act, CASL, or equivalent laws.
• Circumvent, disable, or interfere with any security feature of the Service.
• Scrape, crawl, or extract data from the Service through automated means without our prior written consent.
• Use the Service to create, shorten, or distribute links to content that is defamatory, harassing, hateful, obscene, or exploits minors.
• Misrepresent your identity or impersonate another person, company, or entity.
• Engage in deceptive or fraudulent activity, including misuse of the referral or affiliate programme.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use the Service in a way that could overburden, impair, or disrupt its infrastructure.
• Violate any AI provider acceptable use policies (OpenAI, Google, fal.ai, HeyGen, Suno) when using AI generation features.

Violations may result in immediate account suspension or termination, forfeiture of unused credits, and referral of the matter to law enforcement authorities. We are not required to provide a warning before taking such action.

4.1 Your Responsibility

All AI-generated content (images, videos, music, audio, avatars, marketing copy) is produced by third-party AI models on your instruction. You are solely responsible for reviewing, verifying, and ensuring that any content you generate, publish, or distribute complies with applicable laws, including copyright, defamation, consumer protection, and advertising standards laws.

4.2 Ownership

Subject to the applicable AI provider's terms, you retain ownership of AI outputs you generate through the Service. You grant LinkSnap a limited, non-exclusive licence to store and serve those outputs in connection with operating the Service. We do not claim ownership of your AI-generated outputs.

4.3 No Guarantee of Accuracy

AI outputs may be inaccurate, incomplete, misleading, or objectionable. We provide no warranty regarding the accuracy, quality, or fitness for purpose of AI-generated content. Do not rely on AI-generated content for medical, legal, financial, or other professional advice.

4.4 Third-Party AI Provider Policies

By using AI features you also agree to comply with the acceptable use policies of the underlying AI providers: OpenAI, Google (Gemini / Veo), fal.ai, HeyGen, and Suno. We may restrict or remove access to specific AI features where required by a provider's policies or applicable law.

5.1 How Credits Work

Credits are a virtual currency consumed when you use AI features. Each plan includes a monthly credit allowance. You may purchase additional credits ("top-up credits") at the rates displayed in your dashboard. Credit costs per feature are set by us and visible on the pricing page; we may adjust these with reasonable notice.

5.2 No Cash Value

Credits have no cash value, are non-transferable between accounts, and cannot be exchanged for money. Unused credits expire if your account is terminated or if you downgrade to a lower plan that carries fewer credits.

5.3 Top-Up Credits

Top-up credit purchases are non-refundable once purchased, except as required by applicable consumer protection law. Top-up credits do not expire as long as your account remains active.

5.4 Deduction Policy

Credits are deducted only after a successful AI generation. If a generation fails due to a provider outage or server error on our end, credits will not be charged or will be refunded automatically.

6.1 Subscription Plans

Paid plans are billed monthly in advance via Stripe, our payment processor. Applicable taxes may be added depending on your location.

6.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You authorise us to charge your payment method on file for each renewal.

6.3 Price Changes

We may change subscription prices. We will provide at least 30 days' advance notice via email or in-dashboard notification. Continuing to use the Service after the effective date constitutes acceptance of the new prices.

6.4 Cancellation

You may cancel your subscription at any time from the billing section of your dashboard or by contacting support. Cancellation stops future charges; you retain access to paid features until the end of the current billing period. No partial refunds are issued for the unused portion of a billing cycle.

6.5 Refunds

Subscription fees are non-refundable except: (a) where required by EU/EEA consumer protection law (14-day cooling-off period for digital services, waived upon first use); (b) if we materially change or discontinue a feature you paid for without adequate notice; or (c) at our sole discretion in exceptional circumstances. To request a refund, email support@linksnap.live.

6.6 Failed Payments

If a payment fails, we will retry the charge and notify you by email. After repeated failures your account may be downgraded to the free plan and AI features suspended until payment is resolved.

6.7 Payment Security

All payments are processed by Stripe, Inc. We do not store your card details. Stripe is PCI-DSS Level 1 certified. By providing payment information you agree to Stripe's Terms of Service.

7.1 Programme Overview

LinkSnap operates a referral programme that rewards you for introducing new paying customers. You earn a one-time commission on the first payment and recurring commissions on subsequent payments, at the rates displayed on the Referral page. Rates are subject to change with 30 days' notice.

7.2 Eligibility for Payout

Commissions are paid monthly to verified accounts that have reached the minimum payout threshold. You must provide accurate payout details. Commissions earned through fraudulent, self-referral, or prohibited means will be forfeited and may result in account termination.

7.3 Prohibited Referral Activity

• Self-referrals (referring yourself via a second account).
• Paid advertising that uses our brand name in a confusing or misleading manner without prior approval.
• Spam, incentivised traffic, or misleading representations of the Service to prospects.
• Cookie stuffing, URL hijacking, or other deceptive affiliate practices.

7.4 Tax Obligations

You are solely responsible for reporting and paying any taxes arising from commissions you receive. Where required by law, we may withhold taxes or request tax documentation before processing payouts.

8.1 Your Ownership

You retain all ownership rights in the links, content, and materials you upload or create using the Service.

8.2 Licence to LinkSnap

By using the Service you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, copy, process, display, and transmit your content solely as necessary to provide and improve the Service. This licence terminates when you delete your content or close your account.

8.3 Your Representations

You represent and warrant that:

• You have all necessary rights, licences, and consents to submit your content.
• Your content does not violate any third-party rights or any applicable law.
• The destination URLs of your links comply with this Acceptable Use Policy.

8.4 Our Right to Remove Content

We reserve the right to remove or disable access to any link or content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable, without prior notice.

The LinkSnap name, logo, software, UI design, algorithms, documentation, and all other materials comprising the Service are owned by or licensed to LinkSnap and are protected by copyright, trademark, trade secret, and other intellectual property laws worldwide. Nothing in these Terms grants you any right to use our trademarks, service marks, or other proprietary materials without our prior written consent.

We respect intellectual property rights and expect users to do the same. If you believe that content accessible through the Service infringes your copyright, please send a notice to support@linksnap.live that includes: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and sufficient information for us to locate it; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorised; (e) a statement under penalty of perjury that the information is accurate and you are authorised to act on behalf of the copyright owner; and (f) your physical or electronic signature.

We will respond to valid DMCA takedown notices in accordance with applicable law. Repeat infringers' accounts will be terminated.

The Service integrates with third-party services including Stripe (payments), Supabase (database and auth), AWS S3 (file storage), Upstash (caching and queues), Resend (email), OpenAI, Google (Gemini/Veo3), fal.ai, HeyGen, and Suno. Your use of these integrations is governed by the respective provider's terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Links you create through our Service may direct to third-party websites. We do not endorse, control, or accept liability for the content of those destinations.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

Some jurisdictions do not permit exclusion of implied warranties. To the extent such exclusions are not permitted, our warranties are limited to the minimum required by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINKSNAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) USD $100.

These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions (including the EU and UK) do not allow all of these exclusions, so they may not apply to you in full.

You agree to defend, indemnify, and hold harmless LinkSnap and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your content or the destinations of your links; or (d) your infringement of any third-party rights.

We may suspend or permanently terminate your access to the Service, with or without notice, if:

• You breach these Terms.
• Your account is used for fraudulent or illegal activity.
• We receive valid legal process requiring us to do so.
• Continued provision of the Service to you would expose us to legal, reputational, or operational risk.

Upon termination, your right to access the Service ceases immediately. We may delete your data in accordance with our data retention policy set out in the Privacy Policy. Sections that by their nature should survive termination (including Sections 9, 10, 12, 13, 14, 17, and 18) shall survive termination.

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, internet or power failures, epidemics, or third-party service outages.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which LinkSnap operates, without regard to conflict-of-law principles.

For EU/EEA residents: Nothing in these Terms affects your rights as a consumer under mandatory local law. You may also access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Any disputes not resolved informally shall be submitted to binding arbitration, except where prohibited by law. Class action lawsuits and class-wide arbitration are waived to the extent permitted by applicable law. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.

We may update these Terms at any time. We will notify you of material changes at least 14 days in advance via the email address associated with your account or a prominent notice in the Service. The updated Terms will indicate the new effective date at the top of this page. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree, you must stop using the Service and cancel any active subscription before the effective date.

• Entire Agreement. These Terms, together with the Privacy Policy and any order forms, constitute the entire agreement between you and LinkSnap regarding the Service.
• Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
• Waiver. Our failure to enforce any right or provision shall not constitute a waiver.
• Assignment. You may not assign these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
• No Agency. Nothing in these Terms creates a partnership, employment, agency, or franchise relationship between you and LinkSnap.
• Language. This agreement is made in the English language. Any translation is provided for convenience only; the English version controls.
